The ex-lawyer for the former president has left her position as the US Attorney for New Jersey. This decision was prompted by a legal ruling that challenged her eligibility to occupy the role.
Attorney General's Statement
US Attorney General, the Attorney General, confirmed Habba's resignation on Monday. Bondi stated that the appeals court finding made it "untenable" for Habba to lead the department effectively.
"Let no one confuse following the order as giving up," she wrote. "This battle will now stretch across America."
Court Ruling
Habba's exit comes a week after a federal appellate panel ruled that she had been unlawfully serving as the top prosecutor. This ruling is likely to affect many criminal cases in New Jersey.
The appellate judges said that a temporary posting that bypassed Senate approval violated the Federal Vacancies Reform Act.
Ongoing Legal Battle
It was also stated that she will continue working within the DOJ as a senior adviser. Habba plans to pursue additional appeals of the court's action, with hopes of a different outcome.
Writing online, Bondi argued that judges "should not be able to countermand the President's choice of lawyers entrusted with executing the primary duty of the administration of prosecuting crime."

She praised Habba's record and noted that under her leadership, the state capital of Newark saw a significant drop in offenses. She also stated that the Camden recorded its first summer in half a century with no murders.
Background and Previous Role
The 41-year-old attorney, first joined Trump's personal legal team in 2021. She went on to acted for Trump in his business records case in the previous year, leading to his conviction on multiple felony counts of financial record manipulation.
Earlier, Habba took on the role of US Attorney, the former president had announced he was appointing her as his White House advisor during his second administration, labeling the lawyer as "unwavering in her loyalty" and a "tireless advocate for justice".
